Terms of Service.

 

These General Terms (“Terms”) govern your access to and use of the Fetch Limited website (www.fetch.com.cy), its mobile application, and all associated platforms operated by Fetch Limited and its subsidiaries. By using the platform, you agree to these Terms. If you do not agree, please refrain from using the Platform.

1. Object

Fetch Limited operates a technology platform enabling local stores to offer products and services through a web and mobile application (“APP”). The platform facilitates:

· The placement of orders for products and services from merchants.

· The assignment of couriers (“Couriers”) to fulfill customer (“Customer”) requests, including purchases and deliveries.

· Fetch Limited acts solely as an intermediary and does not assume responsibility for the quality of products or services provided by merchants or Couriers.

· The platform is also an “on demand” intermediary for express courier services, connecting Customers needing errands or purchases with Couriers willing to execute such mandates.

 

2. Terms of Use

By registering and creating a profile, Users (both Customers and Couriers) expressly agree to these Terms, the Privacy Policy, and the Cookie Policy. Users must comply with all applicable laws and Fetch Limited policies when using the Platform.

 

3. Access and Registration for Customers

To register as a Customer:

· You must accurately complete the registration form, providing details such as name, email, phone number, and bank card number.

· You must agree to these Terms.

Users are responsible for maintaining the accuracy of their information and for keeping their login credentials confidential. Fetch Limited is not liable for unauthorized use of accounts or for identity verification failures. Users must immediately notify Fetch Limited if their credentials or payment information are compromised.

 

3.1 Profile Management

· Users can edit their profiles or deregister at any time.

3.2 Credit Card Theft or Removal

· Users must notify Fetch Limited if their credit card is stolen or used fraudulently. Fetch Limited is not liable for losses if Users fail to provide such notice.

 

4. Operation of the Service – Terms of the Mandate

· Customers may request courier services via the Platform for product collection, delivery, or in-person purchases.

· Couriers act under a mandate to purchase and deliver products as instructed by Customers.

· Customers are solely responsible for providing accurate delivery and collection addresses and order details.

· Incorrect information may result in additional costs, for which the Customer is liable.

· If a product’s price is not listed, the Customer may provide an estimate; Couriers may purchase up to 30% above this estimate, with Customer approval required for higher amounts.

· If products are unavailable, Couriers must offer alternatives; if none are accepted, the cancellation policy applies.

· If the Customer is absent at delivery, the Courier will retain non-perishable products for 24 hours (10 minutes for perishables). The Customer bears full costs for undelivered items and must request a new service for redelivery.

· Receipts for purchased products are provided to Customers.

 

5. Product Returns

· Product returns are subject to the merchant’s return policy.

· Customers must contact the merchant directly with the store receipt for returns or claims.

· For incorrect or missing products, Customers must provide photographic evidence and a list of discrepancies.

· Customers must check deliveries before signing; signatures confirm acceptance of the mandate and order.

· Disputes should be reported to Fetch Limited via the Contact Form.

 

6. Prices of Services and Billing

· Registration and use of the Platform is free for Customers.

· Couriers and merchants may incur fees based on location.

· Customers pay only for requested services and purchased products.

· Service prices may vary based on distance, time, and other factors; Customers are informed of approximate fees before payment.

· Fetch Limited reserves the right to change prices at any time, effective upon publication.

· Receipts and invoices are provided electronically.

· If a service is cancelled after a Courier is assigned, Fetch Limited may charge for services already performed and for purchased products.

 

6.1 Payment Platform

· Payments for products/services are made to Fetch Limited, which remits them to merchants.

· Payment to Fetch Limited fulfills the Customer’s payment obligation to merchants and Couriers.

· Payments are processed via authorized Electronic Money Institutions.

· Fetch Limited may preauthorize charges as an anti-fraud measure.

· Fetch Limited is the first point of contact for payment issues, refunds, chargebacks, and disputes.

 

7. Price of Products and Services on the Platform

· All prices include applicable taxes and are displayed in the local currency.

· Product prices may be indicative; final prices are set by merchants.

· Prices may change in real time based on stock and merchant updates.

· The Customer grants the Courier a mandate to purchase products at the merchant’s price.

· Customers are responsible for any incidents arising from the nature of the products ordered.

· Product availability is not guaranteed; price variations up to 30% may be processed without Customer approval, higher variations require Customer consent.

 

8. Promotional Codes

· Promotional codes must be entered before order placement to be valid.

· Fetch Limited may cancel codes in cases of fraudulent use and may sanction Users for abuse.

 

9. Right of Withdrawal and Cancellation of Orders

· Orders can be cancelled free of charge until a Courier accepts them.

· Once a Courier accepts, cancellation incurs a fee equal to 100% of the delivery service.

· If products are already purchased, the Customer must pay for products, delivery, and return services.

· Returns are subject to merchant policies; perishable products may not be returnable.

· Address changes are allowed only within the same city and Courier’s area; otherwise, the order is cancelled, and costs are borne by the Customer.

· Fetch Limited may cancel orders at its discretion, refunding the User as appropriate.

· Official claim forms are available upon request.

 

10. Special Terms for Purchase Service Ordered Through Fetch Limited

· Customers may request in-person purchases by Couriers from merchants with whom Fetch Limited has agreements.

· Orders may be customized with additional instructions.

· Customers are responsible for all incidents related to the nature of requested products.

· Product descriptions and prices are provided by merchants; Fetch Limited does not guarantee their accuracy.

· Product availability and prices may vary; Fetch Limited reserves the right to process orders with price variations up to 30% without Customer approval.

 

10.1 Same-Day Deliveries

· Same-day delivery is available in select cities, subject to operational constraints (location, size, and weight limits).

10.2 Price and Payment Method

· Product prices are set by merchants; final costs are confirmed before payment.

· Payment is by credit card only; Fetch Limited does not store full card details.

10.3 Home Delivery of Free Samples and Commercial Actions

· Fetch Limited may include promotional materials or free samples in deliveries, with User consent.

 

11. Geolocation

· Fetch Limited may collect and use real-time location data with User consent to facilitate assignments.

· Users are responsible for entering accurate addresses; Fetch Limited is not liable for address errors.

 

12. User Obligations

· Users must use the Platform lawfully, in good faith, and in accordance with these Terms.

· Prohibited activities include altering the Platform, infringing on intellectual property, sending spam, introducing malware, and harassing others.

· Users may report violations; Fetch Limited may suspend or remove Users or content for breaches.

 

13. Deregistration by Users

· Users may deregister by contacting Fetch Limited via the Contact Form.

 

14. Fetch Limited’s Responsibility

· Users are responsible for their own internet access and equipment.

· Fetch Limited is not liable for service interruptions, security errors, or damages from viruses, browser malfunctions, or outdated software.

 

15. Responsibility for Content

· Fetch Limited does not control User content and is not liable for its legality or accuracy.

· Fetch Limited may restrict access, remove content, or suspend Users for illegal or harmful activity.

· By submitting content, Users grant Fetch Limited a license to use it for service facilitation and improvement.

 

16. No Warranty in Assignments or Payments

· Fetch Limited does not guarantee the authenticity, reliability, or performance of Couriers.

· Fetch Limited may conduct identity checks but does not certify Couriers.

· Users must exercise caution when delegating assignments.

· Legal claims for liability are limited to the responsible Users or third parties, not Fetch Limited.

 

 

17. Updates and Changes to the Platform

· Fetch Limited may amend these Terms or Platform content at any time without prior notice.

· Users must accept the latest Terms to use the Platform.

 

18. Intellectual Property

· Fetch Limited owns or licenses all intellectual property on the Platform.

· Users may not copy, modify, distribute, or exploit Platform content without written authorization.

· By submitting content, Users assign Fetch Limited rights to use it as permitted by law.

 

19. Severability

· If any clause is found invalid, it will not affect the validity of the remaining agreement, which remains in force.

 

20. Applicable Law

· The relationship between Fetch Limited and Users is governed by Cyprus law, and disputes are subject to the courts of Cyprus.
